From the 6th April 2007, all deposits (for rent up to £25,000 per annum) taken by Flintshire Homes Ltd for Assured Shorthold Tenancies must be protected by a Tenancy Deposit Scheme. This scheme applies to all landlords and letting agents renting property in
What Are Tenancy Deposit Schemes?
The Government have introduced Tenancy Deposit Schemes to ensure tenants get back the amount of deposit they are entitled to at the end of their tenancy. This encourages tenants and landlords to make a clear agreement from the start on the condition of the property making disputes easier to resolve.
How Will This Affect Our Tenants?
Flintshire Homes Ltd already provides a clear and detailed inventory on the condition of rental properties so disputes over deposits are rare. However, as a Flintshire Homes tenant you will be protected from having deposits unfairly held and in the unlikely event of a dispute arising, The Deposit Protection Service will make these disputes easier to resolve.
As a tenant you will still be responsible for keeping the property in the same condition it was let to you and for paying the agreed amount of rent and any other expenses at the correct time.
The Deposit Protection Service
The Deposit Protection Service (The DPS) is open to all. It is the only service that is completely free to use and is run by a company with eight years experience of running a similar scheme in
How Does it Work?
Under the Tenancy Deposit Scheme, tenants will still pay their deposit to Flintshire Homes Ltd.
This deposit will be then be transferred to The Deposit Protection Service until the end of your tenancy.
When The Deposit Protection Service have received your deposit the tenant will be issued with their own unique deposit ID number. This can be used to view their tenancy and deposit details, and access the scheme rules, by visiting www.depositprotection.com.
At the end of the Tenancy
At the end of the tenancy, both parties need to agree how the deposit should be repaid and if there are any disputes.
Landlords, agents and tenants can all request the repayment of a deposit to the appropriate parties at the end of the tenancy – jointly or independently, online or by telephone. When one party requests a repayment, the other needs to confirm whether they agree with the proposal, by completing an acceptance form.
It is in the best interests of all parties to agree how the deposit is to be repaid, so that everyone receives the funds due to them as quickly as possible. All deposits are repaid within 10 calendar days of the correctly completed acceptance form being received by the DPS.
